Terms of Service

The short version: Anashwar Docs is a private facilitation service that helps you procure property documents from official Karnataka government portals (Bhoomi, Kaveri Online, E-Aasthi). We are not a government entity and are not affiliated with, endorsed by, or connected to any government agency. You provide the property details; we retrieve the documents on your behalf using our own registered government portal accounts. The documents we deliver are official government records — their accuracy and legal validity are determined solely by the issuing government authority.

1. About These Terms

These Terms of Service ("Terms") form a legally binding agreement between Anashwar Properties ("Anashwar", "we", "us", or "our"), having its registered office at 3rd Floor, Darbar Square, Opp. Balaji Temple, Ram Mandir Rd, Vijayapura, Karnataka 586101, and you ("User", "you", or "your") — the individual or entity accessing or using the Anashwar Docs platform at web.anashwar.com (the "Service").

By creating an account, placing a document request, or using the Service in any manner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Refund & Cancellation Policy.

If you do not agree with any part of these Terms, you must not use the Service.

2. What the Service Is — and Is Not

2.1 Document procurement facilitation

Anashwar Docs is a facilitation and concierge service. When you request a document, we act as your authorised agent to procure that document from the relevant official government portal on your behalf, using our own Aadhaar-verified, registered accounts on those portals.

You provide the property identifiers (the "7-Point Key": District, Taluk, Hobli, Village, Survey Number, Surnoc, and Hissa). We use those identifiers to locate and retrieve the requested document from the official source. We do not generate, alter, certify, authenticate, or modify any government document.

All documents retrieved through the Service (RTC/Pahani, Encumbrance Certificate, Mutation Register, Signed RTC, NA Order, PT Sheet, E-Khata, and others) are official government records. The content, accuracy, completeness, format, and legal validity of every document are determined solely by the issuing government authority. We make no representation about the accuracy or completeness of the information contained in any government document.

3. Your Authorisation and Representations

By placing a document request, you expressly:

  1. Authorise Anashwar to act as your agent to access official government portals and procure the requested document(s) on your behalf, using Anashwar's own registered portal accounts;
  2. Represent and warrant that you have a legitimate interest in the property for which you are requesting documents — including but not limited to being an owner, prospective purchaser, lender, lessor, lessee, heir, legal representative, advocate, or authorised representative of any of the foregoing;
  3. Confirm that the property details (7-Point Key) you provide are accurate to the best of your knowledge, and that you alone are responsible for any document retrieved against incorrect or incomplete details you supply;
  4. Acknowledge that government land records are public records accessible to any member of the public through the official portals, and that Anashwar's role is limited to facilitating your access to those public records;
  5. Agree not to use the Service for any unlawful purpose, including but not limited to stalking, harassment, identity theft, fraud, or any activity that violates applicable Indian law.

4. Eligibility

You must be at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Service. By using the Service, you represent that you meet these requirements.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@anashwar.com if you suspect any unauthorised use of your account.

Document retrieval depends on the availability and responsiveness of the underlying government portals, which we do not control. Portals may be down, slow, or undergo maintenance. Indicative timelines shown on the platform (e.g., "5–10 minutes") are estimates based on normal portal conditions and are not guarantees. If a document cannot be retrieved within a reasonable period due to portal unavailability, you will be notified and any fee charged will be refunded per our Refund Policy.

9. Intellectual Property

The Service's platform, branding, software, and user interface are the intellectual property of Anashwar Properties. Government documents retrieved through the Service remain the property of the issuing government authority. The AI-assisted Title History Report is an original analytical work product of Anashwar, provided to you for your personal use.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Anashwar disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

Important: The Supreme Court of India has held that a sale deed or property registration alone does not conclusively prove ownership. Always verify RTC, Mutation Register, and Encumbrance Certificate, and consult a licensed advocate before any property transaction.

11. Limitation of Liability

To the fullest extent permitted by law, Anashwar's total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the total amount paid by you to Anashwar for the specific transaction giving rise to the claim, or ₹500 (INR), whichever is lower.

In no event shall Anashwar be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity, arising from the use of or inability to use the Service, or from the content of any government document retrieved through it.

12. Indemnification

You agree to indemnify and hold harmless Anashwar Properties, its officers, employees, and agents from any claim, demand, loss, or damages (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.

13. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, Anashwar has appointed a Grievance Officer:

Grievances will be acknowledged within 48 hours and resolved within 15 days of receipt, in accordance with applicable regulations.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts at Vijayapura, Karnataka, India.

We may update these Terms from time to time. Material changes will be notified by email and/or a prominent notice on the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
